Terms of service

Last updated: May 7, 2026. By using Goliath OS (the "Service") you agree to these terms. If you don't agree, don't use the Service.

Who we are

Goliath OS is a software-as-a-service product operated by Goliath OS Inc. (the "Company," "we," "us"), a corporation registered in Ontario, Canada, servicing customers across Canada and the United States. You can reach us at legal@goliathos.com.

Your account

  • You must be authorized to enter into this agreement on behalf of your business.
  • You're responsible for keeping login credentials secure and for what your team does with them.
  • Don't share your account with anyone outside your organization. Each user gets their own seat.
  • You must provide accurate billing and contact information and keep it current.

Free trial

New accounts get a 14-day free trial of any tier. No credit card is required to start. If you don't convert to a paid plan, your account is paused at trial end — your data isn't deleted until 30 days later, giving you time to export it.

Subscription & billing

  • Plans are billed monthly or annually depending on what you pick. Annual plans get a built-in discount priced into the published rate.
  • You can cancel at any time. Cancellation stops the next renewal — we don't prorate unused time on the current period.
  • We may change pricing with 30 days' notice. The new rate takes effect on your next renewal, never mid-period.
  • Failed payments retry automatically for 7 days. Sustained non-payment pauses your account; another 30 days later, your data is queued for deletion (subject to legal retention requirements).
  • Taxes (GST/HST/PST in Canada, sales tax in the US) are added to your subscription as required by your jurisdiction.

Your data is yours

You own all data your business puts into Goliath OS — customers, jobs, estimates, invoices, photos, time entries, accounting records, AI-generated drafts that you authored prompts for, all of it. You can export at any time from Settings → Data export. We won't sell your data, won't use it to train third-party AI models without your written consent, and won't share it outside the subprocessors documented at /legal/privacy.

What we may do with your data

  • Run the Service for you.
  • Show you aggregated, anonymized benchmarks (e.g. "average HVAC service call closes in 1.4 hours").
  • Provide AI features you've enabled. AI providers are listed in our privacy policy. You can turn AI features off entirely from Settings → AI policy.
  • Investigate fraud, abuse, security issues, and law enforcement requests.

What you can't do

  • Resell or white-label the Service without a partnership agreement.
  • Reverse-engineer the Service, scrape it programmatically beyond your own data via the API, or attempt to extract another customer's data.
  • Use the Service to send unsolicited marketing in violation of CASL (Canada), CAN-SPAM (US), TCPA (US), or any other applicable law.
  • Use the Service for any illegal purpose, or to harm others.

Service availability

We aim for 99.9% uptime. Real-time status is at /status. The Service is provided "as is" — we make no warranty of fitness for a specific purpose, and we don't guarantee the Service will be uninterrupted or error-free. We'll work hard to keep it running and to fix issues fast, and we'll communicate clearly when something goes wrong.

Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We're not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, even if we've been advised of the possibility of such damages.

Termination

You can cancel any time — see Subscription & billing above. We may suspend or terminate your account if you breach these terms or use the Service in a way that risks harm to us or other customers, with reasonable notice where practical. On termination you have 30 days to export your data; after that we delete it (subject to tax/legal retention requirements).

Governing law

These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law rules. For US customers, you also retain any rights you have under your state's consumer-protection laws.

Changes to these terms

We may update these terms occasionally — typically to reflect new features, regulatory changes, or clearer wording. Material changes are notified by email at least 30 days before they take effect. The "Last updated" line at the top of this page tracks the current revision. Continuing to use the Service after the effective date counts as acceptance of the updated terms.
